These Terms of Service ("Terms") govern your access to and use of the Bariatric Shopper's Companion mobile application, also marketed as Bariscan (the "App"), and the website located at https://bariatricapp.com (the "Website"), together referred to as the "Services." The Services are provided by Bari Liquid Force ("we," "us," or "our").

By downloading, installing, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.

1. Acceptance of Terms

By using the Services, you confirm that you are at least 13 years of age (or the applicable age of digital consent in your jurisdiction) and that you have the legal capacity to enter into a binding agreement. If you are using the Services on behalf of another person or entity, you represent that you have the authority to bind that person or entity to these Terms.

These Terms, together with our Privacy Policy, form the entire agreement between you and Bari Liquid Force regarding the Services.

2. Description of the Services

Bariscan is a free mobile application that helps individuals following a bariatric diet identify foods and products that may be compatible with their post-surgery nutritional guidelines. The App allows you to scan UPC barcodes on food products and view related informational content, save favorites, and browse Featured Essentials.

The information presented in the App is intended for general informational and educational purposes only. Product information is sourced from publicly available databases and may not always be complete, accurate, or up to date. Nutritional content, ingredients, and product formulations may change without notice from the product manufacturer.

3. Eligibility and Account Use

The App does not require account creation. You may use the App without registering, providing personal information, or logging in. By using the App, you represent that you meet the age and legal capacity requirements set forth in Section 1.

If you submit your email address through our Website (for example, to receive a notification when the iOS version of the App is available), you agree to provide accurate information and to use that feature only for its intended purpose.

4. Medical Disclaimer and No Professional Advice

The Services are intended to provide general information to assist users who have undergone or are considering bariatric surgery. The Services do not diagnose, treat, cure, or prevent any medical condition. Information provided through the Services should never be used as a substitute for advice from a qualified healthcare professional.

You should:

• Always consult your bariatric surgeon, dietitian, or other qualified healthcare provider before making decisions about your diet, nutrition, supplements, or post-surgery care.
• Follow the specific dietary guidelines provided to you by your healthcare team, which take precedence over any information shown in the App.
• Verify product details, ingredients, and nutritional information directly from product packaging or the manufacturer before consumption, especially if you have allergies, intolerances, or specific dietary restrictions.
• Seek immediate medical attention if you experience symptoms such as severe pain, persistent vomiting, dehydration, dizziness, fainting, or any other concerning post-surgical complications.

Reliance on any information provided by the Services is solely at your own risk.

5. License to Use the Services

Subject to your compliance with these Terms, Bari Liquid Force grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on a device you own or control, and to access the Website, solely for your personal, non-commercial use.

This license does not include any right to:

• Resell, rent, lease, sublicense, distribute, or commercially exploit the Services.
• Modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works of the Services, except to the extent such restriction is prohibited by applicable law.
• Remove or obscure any copyright, trademark, or other proprietary notices in the Services.
• Use any automated means, including bots, scrapers, or crawlers, to access or extract data from the Services.
• Use the Services in any manner that could damage, disable, overburden, or impair the Services or interfere with another user's enjoyment of the Services.

6. Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services to:

• Violate any applicable law, regulation, or third-party rights.
• Transmit any viruses, malware, or other harmful code.
• Attempt to gain unauthorized access to the Services, our systems, or any related infrastructure.
• Use the Services to harass, abuse, defame, or harm any other person.
• Misrepresent product information shown in the App to other users or third parties in a misleading or deceptive manner.

We reserve the right to terminate or restrict your access to the Services at any time, without notice, for any conduct that we believe, in our sole discretion, violates these Terms or is otherwise harmful to other users, us, or third parties.

7. Intellectual Property

All content, features, and functionality of the Services, including but not limited to the App's software, code, design, text, graphics, logos, icons, images, audio clips, and the compilation of all such content, are the exclusive property of Bari Liquid Force or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

"Bariscan," "Bariatric Shopper's Companion," and "Bari Liquid Force" are trademarks of Bari Liquid Force. You may not use these marks without our prior written permission. All other trademarks, product names, and brand names appearing in the Services are the property of their respective owners and are used for identification purposes only.

8. User-Provided Content and Feedback

If you submit any feedback, suggestions, ideas, or other communications to us regarding the Services ("Feedback"), you grant Bari Liquid Force a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, and otherwise exploit such Feedback for any purpose, without any obligation or compensation to you.

9. Third-Party Services and Links

The Services may include links to third-party websites, services, or resources, including but not limited to bariliquidforce.com, the Google Play Store, and product listings on Amazon.com. These third-party services are not under our control, and we are not responsible for their content, accuracy, availability, privacy practices, or any transactions you may conduct with them.

Your use of any third-party services is at your own risk and is governed by the terms and privacy policies of those third parties. We encourage you to review their terms before using or making purchases through any linked services.

10. Product Information Accuracy

Bariscan displays product information sourced from publicly available product databases and other third-party sources. While we strive to present accurate and helpful information, we do not guarantee the accuracy, completeness, reliability, or timeliness of any product data shown in the App, including but not limited to:

• Nutritional values (calories, protein, sugar, carbohydrates, fat, fiber, etc.)
• Ingredient lists and allergen warnings
• Product names, brand names, packaging, or images
• Bariatric compatibility ratings or recommendations
• Pricing or availability

Always verify product details by reading the actual product packaging before purchase or consumption, particularly if you have specific dietary restrictions, allergies, or medical conditions.

11. Disclaimers and "As Is" Provision

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BARI LIQUID FORCE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Services will be uninterrupted, error-free, secure, free of viruses or other harmful components, or that any defects will be corrected. We make no warranty regarding the accuracy, reliability, or completeness of any content or information made available through the Services.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BARI LIQUID FORCE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, HEALTH, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL CUMULATIVE LIABILITY OF BARI LIQUID FORCE TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Bari Liquid Force and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use or misuse of the Services; (b) your violation of these Terms; (c) your violation of any applicable law or third-party rights; or (d) any health-related decision you make in reliance on information from the Services.

14. Termination

You may stop using the Services at any time by uninstalling the App and ceasing to access the Website. We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms.

Upon termination, the provisions of these Terms that by their nature should survive termination will continue to apply, including the provisions regarding intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

15. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the United States and the State of Iowa, without regard to its conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Iowa, and you consent to the personal jurisdiction of such courts.

You agree that any dispute will be brought in your individual capacity and not as a plaintiff or class member in any purported class action, consolidated action, or representative proceeding.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, the Services, legal requirements, or other factors. When we make changes, we will update the "Last Updated" date at the top of this page. If we make material changes, we will provide prominent notice (such as a notice on the Website or within the App).

Your continued use of the Services after any changes to these Terms constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Services.

17. Severability and Waiver

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

18. Google Play Terms

The App is distributed through the Google Play Store. Your download and use of the App is also subject to the Google Play Terms of Service. In the event of a conflict between these Terms and the Google Play Terms regarding the distribution of the App, the Google Play Terms will prevail solely with respect to that distribution.
